In 2024, Queensland implemented significant changes to its rental laws aimed at improving the rights of tenants and stabilising the rental market. These reforms were part of the broader Residential Tenancies and Rooming Accommodation and Other Legislation Amendment Act 2024, which introduced both immediate and phased changes.
Rent increases are now limited to once every 12 months, and this applies to the property rather than just the tenancy agreement. This is intended to stabilise rents and prevent frequent increases when tenants renew their leases.
From September 2024, all rental properties must comply with new minimum housing standards to ensure they are safe, secure, and functional. These standards include requirements for weatherproofing, adequate plumbing, and functioning kitchen facilities.
If a person is selling a property in Queensland with a tenancy, the Contract now provides that the Seller warrants that the information contained in the Contract regarding tenancy arrangements, including rent increases, is true and correct. If this information is found to be incorrect, the Buyer may have rights to compensation under the Contract.
