A company Power of Attorney is a document appointing an attorney to make decisions and enter transactions on behalf of the company. It is possible to limit the scope of the attorney’s decision-making power.

The Attorney’s power to make decisions may occur:

with immediate effect;
upon a certain trigger event (such as death or loss of capacity of a key person in the company);
from a nominated date.

Prior to appointment, it is important to consider whether the attorney has sufficient skill and knowledge required to make decisions for the company.
