In Australia, you may apply for a divorce where:

you have been separated for more than 12 months;
there is evidence of the marriage (such as a marriage certificate);
the marriage has irretrievably broken down (ie- there is no reasonable likelihood that you will reconcile);
the Court has jurisdiction (for example: you are Australian citizens, you intend to live in Australia indefinitely, you ordinarily lived in Australia for at least 12 months prior to making an application).
